They were likewise pressured by the European commission for years (as well as Albania, Montenegro, Northern Macedonia and many other countries). As for Austria, its citizenship by exception scheme is obviously illegal, as opposed to CBI schemes since the EU law is based on the principle of the rule of law which mandates that any legal decision should made according to law not to some arbitrary decision of a bureaucrat. As for the CBI schemes, they are perfectly legal under the EU law including the “sincere cooperation” clause because it does not mean that member states should amend their legislation to address European commission wishes. Also, there’s no such legal principle as a “genuine link” requirement. Citizenship by birth is granted by every country based on just place of birth or citizenship of parents which is a very weak link, at least its not in any way better than a legal residence which establishes some indirect connection with a country.
